Mental Health Evaluation for Court

When the mental health evaluation is for the court or an employer, a much longer evaluation is typically needed than a regular clinical evaluation. The evaluator needs to investigate the circumstances that led to the client’s mental fitness being questioned and any mitigating circumstances, which may have led to behavior that is out of character. If allegations against the client appear to be false or exaggerated, the evaluator should address these allegations, and allow the client time to tell his or her side of the story.

The Mental health evaluator should demonstrate who the client is as a person based on history and collateral evidence and include any mitigating circumstances that may have led to behavior that was typically out of character.

A mental health evaluation is a clinical interview conducted with the purpose of screening for mental illness. It is a conversation between the psychiatrist and the patient to help decide the kind of support that they need. The initial screening is usually followed by more specific testing.

Such an evaluation is also used to screen for trauma, defenses, personality traits, external stressors, and medical illness, which may be contributing to mental health symptoms.

In some cases, its purpose is to determine safety and risk to self and others. An evaluation can also be used for clinical treatment, employment, court, child custody, or criminal defense.
