There are generally two types of psychosexual evaluation:
- Psychosexual evaluation for clinical treatment (No court order)
- Psychosexual evaluation for court
A Psychosexual Evaluation for Clinical Treatment may be requested for the following reasons
- An individual is having sexual thoughts that are disturbing or upsetting to them.
- An individual is having sexual fetishes or behaviors that are affecting their relationships and ability to experience sexual pleasure
- A person is experiencing asexuality or loss of sex drive
- An individual or couple is seeking sex therapy.
Typically, people with worrying sexual thoughts or behaviors do not break the law or harm others, but themselves feel distress or relationship disturbance.
Psychosexual Evaluation for Court
You may need a psychosexual evaluation for court if you have been charged with the following crimes.
Types of sexual offenses:
Public Lewdness
Indecent Exposure
Looking at child pornography
Pedophilia
Having a consensual sexual relationship with an adolescent, or someone over the age of 13 but under the age of 18.
Revenge porn
Inappropriate touching of a minor ( individual under the age of eighteen)
Inappropriate touching of an adult
Rape
Grooming a minor
Violent sexual assault
Sexual Trafficking
Soliciting a prostitute
Charges for sexual crimes vary a lot in severity, and the purpose of an evaluation is to determine intent, dangerousness, and risk of re-offending.
Every situation is different. Consequences of having an evaluation completed by an inexperienced, unqualified, or untrained interviewer can lead to longer sentences and excessive monitoring for minor, non-violent crimes.
Ideally, a psychosexual evaluation for court should be completed by a Board Certified Psychiatrist with forensic experience. It is important that the interviewer does not conduct an insufficient or incomplete report due to negative countertransference or feelings towards the client.
A psychosexual evaluation requires
an approach that is:
Thorough
Professional
Clinical
Objective
Non Judgemental
Considers treatment and rehabilitation
Board Certified Psychiatrists at Gaba Telepsychiatry are experienced conducting psychosexual evaluations For court
When pleading not guilty, the purpose of the evaluation is to determine:
Risk factors for dangerousness
Intent
Evaluate other psychiatric illnesses
Screen for brain injury
Screen for autism and vulnerability to exploitation
Whether your story is believable
Whether your story is consistent
Whether your story is consistent with the evidence.
Risk of repeat arrest or reoffending.
Whether you are a danger to the community
Psychosexual Evaluation for Court
There are several reasons why you may need a psychosexual evaluation for court
You have been accused of a crime and want to tell your side of the story and attempt to demonstrate your innocence

You have been charged excessively for a relatively minor crime
Examples of minor crimes can include exhibitionism, masturbation, public lewdness, lewd comments, making unwanted advances, but not forcing oneself, misinterpreting signals, but not forcing oneself on another.
If your crime is not violent and you do not feel you are a candidate for monitoring or sex offender groups, this may be a reason to have a psychosexual evaluation.

You intend to plead guilty to a crime and want to demonstrate that you are not a danger to the community prior to a plea deal. You want to explain mitigating circumstances with a request for a more favorable plea.

- You want to demonstrate that you have sufficient insight and impulse control to avoid re-offending.
- You want to be assessed for medical conditions such as traumatic brain injury or psychosis, which may have contributed to impaired judgment or disinhibition.

- You want to demonstrate, and you have sufficient insight to take the steps needed to avoid reoffending.
You want to make sure you are not subjected to excessive monitoring
Common questions:
How are convicted sex offenders monitored
Will I need sex offender monitoring?
How long will it take to need monitoring as a sex offender?
Will I have to wear an ankle bracelet?
After being convicted of a sex offense, you may be mandated to participate in community monitoring.
Types of monitoring include:
Level One Monitoring
Level one monitoring means you must notify the relevant authorities of your location.
You also may not be allowed to work in certain places, like schools. However, you do not have to wear an ankle bracelet, and your name is not listed online as a sex offender.
Level Two Monitoring
Level two monitoring means that you are listed online as a sex offender. Your neighbors can look you up and see that there is a convicted sex offender living in your residence.
Level Three Monitoring
Level three monitoring means you may have to wear an ankle bracelet and be listed online as a sex offender. Level three monitoring is typically reserved for violent sexual crimes, crimes involving children, and repeat offenders.
SORAG
How is the level of monitoring of convicted sex offenders determined?
The level of monitoring of sex offenders is determined by a psychiatric evaluation and also the SORAG. However, the SORAG has multiple limitations.
- It may not be scored by a qualified person.
- It is not appropriate for crimes such as viewing child pornography.
- It is not appropriate for crimes such as public lewdness.
If you and your attorney feel the level of monitoring recommended is excessive for the crime, it may be worth getting a second opinion, as in many cases, there are errors in the manner in which the SORAG is scored and administered.
Consequences of excessive monitoring
- Prisoners are unable to move forward with their lives after serving their sentence.
- Family and children may be subject to verbal and physical attacks as well as humiliation.
- Community resources are spent monitoring individuals who are at very low risk of reoffending or have been convicted of non-violent crimes. This means those convicted of serious sexual crimes such as rape, grooming of minors, and violent sexual crimes, as well as repeat offenders, are not monitored.
Schedule an appointment for a second opinion if your level of monitoring is excessive
Be Realistic
If you have been convicted of a relatively minor, non-violent crime, then it is worth getting a second opinion.
If you are a repeat offender or have been convicted of serious, violent, or exploitative sex crimes, you may not be entitled to a lower level of monitoring. The focus may be on rebuilding your life.
Psychotherapy is an important part of rehabilitation, as those convicted of sexual offenses face prolonged stigma, difficulty gaining employment, and difficulty forming new relationships. If you meet the criteria for prolonged level two or three monitoring, focus on rebuilding your life.
The purpose of the initial screening appointment would be to give you an idea of the likelihood that your application will be successful. We may advise you not to go forward with the application if you meet the criteria for prolonged level two or three monitoring.
You have served your period of monitoring
Can I stop being monitored as a sex offender?
If you have completed your recommended period of monitoring or you feel you are eligible to reduce your level of monitoring, you will need a psychosexual evaluation to demonstrate that you are not a danger to the community. This usually includes:
- Demonstrating that there have been no subsequent charges or arrests
- Demonstrating insight
- Demonstrating adherence to treatment
- Demonstrating that years and age have contributed to maturity
- Demonstrate that you understand the consequences of re-offending.

You want to appeal your sentence
How can I appeal my sentence for a sexual offense?
Sentences for sexual offenses can be both excessively harsh and excessively lenient. A lot depends on the emotional response of the Judge and jury, their view of the victim, the view of the defendant, and their own personal experiences. While severe sexual offenses usually require jail sentences, sometimes sentences are more severe than for murder.
If you have been found guilty of a crime, you may have to serve a jail sentence. However, if you and your attorney feel that the sentence is disproportionate to the crime, a psychosexual expert may help appeal your sentence. The goal of the evaluation would be to demonstrate:
- Remorse
- Level of insight
- Dangerousness
- Risk of reoffending
- Strategies to prevent the risk of repeat offenses
- Post-discharge monitoring plan
- Motivation not to be re-incarcerated
A thorough psychosexual evaluation may provide the judge and parole board enough information to allow them to feel comfortable reducing your sentence. Ultimately, the goal is to request that the sentence be proportionate to the crime and the level of an individual’s risk to the community.
Learn more about how acquiring a psychosexual to appeal your sentence
Once again, it is important to be realistic, and if you have committed a serious crime, an appeal may not be effective.
I am a repeat sexual offender
Psychosexual evaluations are rarely successful in assisting appeals and lenient sentences for repeat offenders who commit serious crimes. However, a psychosexual assessment may help identify Brian’s lesions, which could be contributing to the repeat offense. It such cases, an offender may be transferred to a forensic psychiatric facility.
Likewise, medications can be recommended to reduce aggression and impulsivity.

How to prepare for a psychosexual evaluation?
- Try to obtain your medical records if possible.
- Provide evidence of completing mandated courses if applicable.
- See a therapist, demonstrate that you are working on yourself.
- Acknowledge responsibility where applicable.
- As your attorney, for copies of court motions and discovery.
- Try to maintain employment if possible.
- Obtain character references where applicable.
- Demonstrate adherence to substance abuse treatment.
- Demonstrate insight and what can be done to avoid the risk of future arrests or convictions.
Generally, the evidence is in the discovery. You cannot admit to something that you did not do. However, be as truthful as possible. The fact that your story is consistent with evidence and does not change is an important factor in determining whether you will be believed. Do not omit details even if embarrassing.
For example, if you were masturbating on the beach, admit that it is what happened. Explain the details, for example, that you were intoxicated and did not think anyone was watching or paying attention. Demonstrate that you did not intend to embarrass, hurt, or violate anyone else and that you have learnt your lesson. Do not deny that the event ever happened, even if your motive for lying is embarrassment. Not telling the truth during an evaluation, especially if the evidence against you is clear, has a negative impact on your credibility and does not demonstrate that you are at low risk of reoffending.
Instead, demonstrate an understanding of the precautions that you need to take to avoid further arrests, e.g., don’t drink in public, never assume you are not being watched, psychotherapy if needed. Sometimes, very benign medications like antidepressants can reduce sex drive. Show insight and demonstrate a desire not to let the same thing happen again. Also, demonstrate that you are able to follow through on steps that will prevent reoffending.

Psychosexual evaluation for clinical treatment
The overwhelming majority of individuals with distressing sexual thoughts and behaviors do not commit crimes, but may require treatment due to distress or interference with relationships.
Asexuality
Means you are content not having sex frequently, however this may cause distress to your partner and may be causing problems in your relationship. You may be content just to read a book, watch a film, or have a conversation with your partner.
Loss of sexual desire
This is most commonly due to medical illness, stress, or relationship discord.
Sexual Paraphilias
A paraphilia is considered a persistent inability to be aroused by normal sexual intercourse. Instead of being exclusively aroused by sexual behaviors, which may seem strange to many. While many paraphilias, such as foot fetishes and role play, can be considered harmless, some can potentially get you into legal trouble, for example :
Voyeurism: (Peeping Tom) watching others have sex, who do not know they are being watched
Froteurism: Rubbing against others in the train, bus, or crowded space without their consent.
Exhibitionism: Exposing oneself in public.
Paraphilias may or may not be associated with childhood trauma
Goals of therapy include sublimating sexual desires without violating the rights of others.
OCD with sexually intrusive thoughts
Individuals with OCD and sexual intrusive thoughts do not act on them and do not become aroused by them. However, the thoughts can cause a significant degree of distress.
Examples of thoughts include:
- You are a rapist
- You are a dirty pedophile
- What if I am a rapist
If sufferers do have thoughts, they are typically ashamed and may not seek treatment due to fear of being arrested, not realizing a person cannot be arrested for having a thought.
Violent intrusive thoughts usually subside with medication, and OCD with violent intrusive thoughts is usually treatable with a combination of medication and therapy.

If you are guilty of a sexual offense, we cannot guarantee that you can avoid a jail sentence. However, a thorough professional psychosexual evaluation will help your attorney provide the best possible representation. Ultimately, you may achieve leniency if you can demonstrate a consistent commitment towards taking the required steps to prevent reoffending.
Likewise, if you feel you are ‘not guilty’ of the charge, the psychosexual evolution can help with your defense.
Psychosexual evaluations for clinical treatment are much simpler and are aimed at accepting oneself, managing symptoms, navigating relationships, and reducing distress.
